AN ORDINANCE OF THE CITY OF PUYALLUP AMENDING TITLE 18, COMPREHENSIVE PLAN, OF THE PUYALLUP MUNICIPAL CODE

TO IMPLEMENT ESHB 1724 ­ THE "REGULATORY REFORM ACT"

WHEREAS, the Washington State Legislature adopted ESHB 1724, Chapter 347, Laws of 1995, which directs local governments to modify their land development permit procedures to provide certainty for development decisions, ensure that permits are reviewed and issued in a timely manner, provide opportunities for public comment regarding proposed developments, and adopt local Shorelines Management Master Programs as elements of their comprehensive plans; and

WHEREAS, the City Council has previously adopted Title 18, Comprehensive Plan, of the Puyallup Municipal Code, which establishes the purpose and intent of the comprehensive plan and defines its various elements; and

WHEREAS, the Planning Commission has considered draft amendments in workshop sessions on January 10, January 24, and February 7, 1996; and

WHEREAS, the Planning Commission conducted a duly advertised public hearing on February 28, 1996 to consider the proposed amendments and voted to recommend the City Council adopt the proposed amendments to Title 18 of the Puyallup Municipal Code; and;

WHEREAS, this ordinance reflects the amendments recommended by the Planning Commission; NOW THEREFORE,

BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF PUYALLUP AS FOLLOWS:

Section 1. The following sections of Title 18 of the Puyallup Municipal Code are hereby amended as shown on Exhibit "A" attached:

Sections 18.10.005, 18.40.050, and 18.40.060.

Section 2. This ordinance shall become effective five days after publication in the official newspaper of the City of Puyallup.

18.10.005 Purpose and intent.

The comprehensive plan will establish the principles, goals, objectives and policies guiding land use regulations within the city of Puyallup in compliance with Chapter 36.70A RCW, Washington State Growth Management Act. The plan serves as the basis for development of zoning and subdivision regulations for the control of the use of private and public lands, and as a guide for development of environmentally critical areas protection regulations, capital facilities programs, capital budgeting decisions, provision of adequate public facilities, meeting housing needs of the community, and design of transportation systems.

The intent of this title is to encourage early and continuous opportunities for public participation in development and the annual amendment process of the comprehensive plan, as required in RCW 36.70A.140, State Growth Management Act. (Ord. 2352 § 1, 1993).

18.40.050 Adoption of comprehensive plan.

There is adopted by reference a comprehensive plan, on file with the department of planning and community development, as subsequently amplified, augmented and amended pursuant to the provisions in this title, consisting of:

(1) The City of Puyallup Comprehensive Plan (September, 1994) which includes the following:

(a) Foundations Chapter;

(b) Environment Element;

(c) Land Use Element;

(d) Housing Element;

(e) Community Character Element;

(f) Transportation Element;

(g) Utilities Element;

(h) Capital Facilities Plan Element; and

(i) Downtown Revitalization Neighborhood Plan.

(2) Comprehensive Park and Recreation Plan as periodically amended (Ord. 2411 § 2, 1994).

(3) Shorelines Management Master Program goals and policies.

18.40.060 Adoption and amendment of future land use map.

(1) This title includes a map known, cited, and referenced as the city of Puyallup comprehensive plan future land use map which depicts the location and boundaries of various land use classifications, references and other information shown thereon, which map is incorporated by reference as part of this title.

(2) A true and correct copy of the future land use map shall be kept in the office of the planning and community development director, and shall be revised to reflect all comprehensive plan land use map amendments within five days of enactment of said amendments. Said future land use map shall contain the date of initial adoption and the date of each subsequent revision. (Ord. 2411 § 2, 1994).
