A RESOLUTION REGARDING ACCESS TO ELECTRONIC INFORMATION AS CONTAINED IN THE CITY'S GEOGRAPHIC INFORMATION SYSTEM (GIS), ESTABLISHING PROCEDURES FOR PROVIDING ACCESS TO SUCH INFORMATION BY THE GENERAL PUBLIC IN COMPLIANCE WITH THE PUBLIC DISCLOSURE ACT CHAPTER 42.17 RCW.

WHEREAS, the City of Mountlake Terrace has undertaken an effort to build and maintain a Geographic Information System (GIS) to provide more efficient service to its citizens, and

WHEREAS it is the intent of the City of Mountlake Terrace to provide access to such information as permitted or required by law, and

WHEREAS, RCW 42.17 the Public Disclosure Act requires the City to make all public records available for public inspection and copying with limited exceptions and

WHEREAS, no other state legislation provides guidance to providing access to GIS data and

WHEREAS the Public Disclosure Act applies to existing records at the time ot request, and as such does not constitute a mandate to create new records or create custom products to fulfill such requests, and

WHEREAS, it is the intent of the MountIake Terrace City Council to make available all existing GIS data that is subject to disclosure under RCW 42.17 at minimal cost.

NOW, THREFORE BE IT RESOLVED, that the following sections shall be the policy of the City of Mountlake Terrace regarding access to GIS products and services and establishment of costs associated with the production of the requested information

Section 1 - Purpose.

A. The intent of this resolution is to provide full access to non-exempt GIS information that is in public records establish guidelines for access to such data and to set up a rate structure for providing GIS data.

Section 2. Compliance with Request for GIS data

A. The City shall notIfy the requestor within five (5) working days as to whether the request can be fulfilled and if so, when. The five day period begins when the City's Public Works Director or hisdesignee receives a written request. If the City determines a request description to be insufficient to begin processing, the requestor shall be promptly notified that the request cannot be processed without additional information. This shall satisfy the five day reply requirement. Receipt of an augmented request description shall open another five day reply window.

B. The City shall respond promptly in fulfilling such requests. The nature of the request, the content and location of the records. as well as the staff size and current and anticipated workload shall bear on the reasonable expeditiousness of the response.

Section 3. Eligibility

A. All data existing at the time of a GIS data request shall be deemed available for fulfilling such requests. Data that must be created or otherwise manipulated is considered a custom product and as such is not subject to the Public Disclosure Act.

The City may, at its option, enter into an agreement to comply with such requests at the discretion of the Public Works Director or his designee. Written agreements shall be required for and special fees shall be charged for all custom GIS products and services. An estimated payment fee, or asigned written agreement specifying the fee, must be received before work will be performed for acustom product. Fees received for custom GIS products and services shall be reinvested by the City in the GIS. The City of Mountlake Terrace shall comply with the terms of all software license agreements with vendors.

Section 4. Rate Structure

A. The City of Mountlake Terrace shall provide GIS data at duplication costs. Fees shall be based on an hourly labor cost for staff (including employee benefits) and computer time, as well as the cost of the media on which the GIS data is supplied. Additional costs for documentation and any necessary postal costs will be incurred by the requestor. Media may be supplied by the requestor if desired. Payment is due prior to fulfillment of any requests and shall be based on the City's cost estimate. The 1995 costs are as follows:

  1. Hourly Rate for GIS Requests -- $35.40 per hour
  2. Cost for 4mm DAT Tapes -- $25.00 each
  3. Color Map Products @ $3.00 per square foot

    • E Size (36'x48") (map size) -- 12.00 (sq. ft.) -- $36.00 (cost)

    • D Size (24'x36") -- 6.00 -- $18.00

    • C Size (15"x24") -- 3.00 -- $9.00

    • B Size (11"x17") -- 1.30 -- $3.90

    • Legal Size (8 1/2" x14') -- 0.83 -- $2.49

    • LetterSize (8 1/2" x 11") -- 0.65 -- $1.95

    • Black and White Xerox Copies -- @.15 per page

    • Large Format Copies (18"x24") -- $1.00 per page

    • Large Format Copies (24"x36") -- $2.00 per page

    • Large Format Copies (36"x48") -- $4.00 per page

The above costs are subject to change.

Section 5. Media and File Formats

A. Because GIS data commonly involves very large amounts of data, the City shall provide such data on 4mm DAT tape in either SMS (Storage Management System) or NovelI SIDF (System Independent Data Format) data formats.

Section 6. Exceptions

A. The City, at the discretion of the Public Works Director or his designee, may waive the above fee structure in the event the City wishes to enter into an agreement with another public agency requesting GIS data. Such exceptions shall be to facilitate the sharing of geographic data that is deemed mutually beneficial to each GIS data provider so as to minimize public expense in creating and maintaining Geographic Information Systems.

Section 7. Public Disclosure Act

A. Nothing in the this resolution shall be construed to be in conflict with the Public Disclosure Act.

Section 8. Immunity from Liability

A. In making GIS data accessible, the City makes no warranty of accuracy. The information contained in the fulfillment of any GIS data or map request was compiled for use by the City of Mountlake Terrace, its employees and consultants. The City of Mountlake Terrace does not warrant the accuracy of any data or map. Any person or entity requesting GIS data should conduct an independent inquiry regarding the accuracy of all information provided. Neither the City of Mountlake Terrace nor its employees or representatives shall be liable for the information provided nor for any oral representation provided based on said data.
